Obtaining District Residency

UTAH ADMINISTRATIVE CODE 53G-6-302: THE SCHOOL DISTRICT OF RESIDENCE FOR A SCHOOL AGE CHILD IS:
 
1. Where the custodial parent resides, (i.e., Washington County).
 
2. Where the married or emancipated minor resides, (i.e., Washington County).
Enroll at the boundary school or age appropriate alternative/adult high school.
 
3. The District where the child resides, if:
     a. The child is in the custody or under the supervision of a Utah State Agency, or a public or private agency that is authorized by the State of Utah to provide services
     in Washington County.
     b. In such case, a pre-enrollment meeting is required (grades K-12).

 4. While living with a responsible adult who resides in the Washington County, and the custodial parent lives in Utah, and it has been determined by the District that:
     a. The child’s physical, mental, moral, or emotional health will best be served by considering the child to be a resident for school purposes.
     b. Exigent circumstances exist that did not permit the child to attend under WCSD’s Open Enrollment procedures.

In either case, the Washington County School District (WCSD) Durable Power of Attorney MUST be completed/submitted to WCSD Department of Student Services for consideration and approval.

5. When the custodial parent does not reside in Utah, but the child is living with a non-custodial parent, grandparent, brother, sister, uncle, or aunt (who meets the definition of a responsible adult).
The Out of State Enrollment Application  along with the Washington County Durable Power of Attorney MUST be completed/submitted to Student Services for consideration and approval.

6. When the custodial parent does not reside in Utah, however, it has been established to the satisfaction of the District that the custodial parent is moving to Washington County within a reasonable timeframe, in the meantime the child will be residing with a responsible adult who is a resident of the District.

The Out of State Enrollment Application along with the Washington County Durable Power of Attorney MUST be completed/submitted to Student Services for consideration and approval. If approved, enrollment is considered “provisional” which is subject to the relocation of the custodial parent.
Note: Consideration will also be given to students grades 9-12 whose custodial parent is relocating out of District and the student/parent wishes for them to complete the current school year in WCSD.

7. When the custodial parent does not reside in Utah; however, it has become necessary for the custodial parent to consider having the child live with a responsible adult who is resident of the District.

The Out of State Enrollment Application  MUST be completed/submitted to WCSD Department of Student Services for consideration and approval. If approved:
Guardianship MUST be obtained through the Washington County Court’s Online process at: https://utcourts.gov/ocap/index.html
Note: Once you have completed the form titled “Affidavit of Waiver by the School District”, submit it to Student Services for approval/signature. When all documents required by the courts are completed, file your request with the courts. However, to expedite enrollment with the District, you may provide documentation of the court case number and date assigned to the Student Services.

What is a Responsible Adult?
A person 21 years of age or older who is a resident of the Washington County School District who is willing and able to provide adequate supervision, food, clothing, shelter, and educational support for a minor child. A person with whom the child’s mental, moral, physical, and/or emotional health would best be served.

This person will assume responsibility for any fees or other charges relating to the child’s education; and/or if eligible for fee waivers will provide the District with financial information as needed for that purpose.

All students attending Washington County School District are to abide by the policies of the School/District in which attendance is sought. The student’s attendance in the school shall not be detrimental to the School/District.
